The U.S. Department of Justice (DOJ) is accusing the American Civil Liberties Union (ACLU) of misleading it during court proceedings that ended last month with the abortion of an undocumented minor’s baby.
“Jane Doe,” the legal pseudonym for the pregnant teen who entered the United States illegally and is being held in a federal facility in Texas, had an abortion in the early hours of Oct. 25, before government lawyers had time to appeal an earlier court ruling allowing the abortion.
The DOJ alleges ACLU attorneys said in court the abortion would not take place until the following day. DOJ spokesman Devin O’Malley said in a statement the deception thwarted Supreme Court review and that “discipline may be warranted against Jane Doe’s attorneys.”
The federal government is also asking the Supreme Court to nix the appeals court ruling that granted permission for the abortion. —S.G.
